Oh, my beautiful serene PDPI.

The is the time of Christmas, here I would like to wish every body a Merry Christmas and Happy New Year. How I really wish peace and harmony prevail upon us, all of us in PDPI or even so the world.

Unfortunately, I am filled with a heavy heart. On 16th December 2008 some thing terrible had happened. Residents were threatened and bashed up by fellow resident over some minor issues. The worst and ugly thing about this incident were those hidden hand involved that instilled and stirred up the whole issue. Hatred, suspicion, anger and other negative elements were being blown up to the surface.

I'm sure many of us who have been staying here for the past years have taken pride in our nice, serene and peaceful surrounding. I too has considered this place my home sweet home. Nice out-door environment regardless of whether the garden is tiled-up or not. Friendly people to talk to, to share some moments of our lives.

All this just varnished, dissipated into thin air with such ugly incident. Residents are now regarding each other with suspicion. Rumours flying all over the taman. PDPI has been transformed from a serene beautiful garden into an ugly terrorising gangster land.

OH! God or whatever higher power it is to be, please help us, the poor souls in PDPI.

1st POSTER BY THE MC

Here's a post from one of our reader.



Dear Residents,

Sometime in June 2008, the MC put up the below their FIRST poster in a locked up notice board. It was believed this poster sparked up a debate on the car park project in the our beatiful garden proposed by the MC. Some said also the current tense and violent situation in our once peaceful Taman/Apartment.

During that time, residents offered counter views by posting posters on the glass panel and wall near the lift. However, all posters by residents were mysterious tore away the moment they were pasted up.

I decided to make available this poster prepared by the MC, word by word for your reading pleasure.

Please note that the “car lots for rental” project have been rejected in an election conducted by the MC in July 2008. In fact all 4 projects proposed by the MC, were rejected by the unit owners in that election.

Let us rewind back the time and revisit this FIRST poster by the MC.

Why we need to generate car lots for rental?

1. Survey done about 75% residents ask for help to have additional car lot. Car is a necessity and no more a luxury item because Penang transport system is really bad not like singapore.

2. Plan is to use the front garden (N Block) and the back garden (L Block) for the car lots. Children playground and the fish pond will be maintained but will be upgraded. Why front and back? Because that places is only used by the sun and the rain and our residents only used the middle garden during morning and sunset.

3. To sustain the current maint. Fee and bear in mind, 900 sq feet and above apartment we are still the cheapest in penang. Even comparing facilities, we are still the best.

4. It does not make sense if we give excuse as cut garden the price or value will drop. Today’s buyers is looking for additional car lot due to conveninence sake, just like Tesco, Giant and Sunshine supermarkets. (No convenient and not enough car parks, business will be effected like super komtar closed down).



5. Another excuse as “U agree to buy here and if u hv 1 car lot stick to 1”, more than 1 car, pls park outside” The words we speak today should be soft n tender, for tomorrow we may have to eat them”. If we got the opportunity to upgrade n help, we should give our moral support. Remember why residents bought the additional car lots from Hamna last time???? Why don’t they park outside since they also got 1 car lot? Let’s avoid selfish mentality and work together for the betterment of our areas.

6. To park outside is risk taking esp. middle of the night, we have cases of robbery, spot rims and tyres missing before to our residents. Caring mentality is needed here.

7. Normally people who are against it, are those not interested in the future, children not staying with them or very comfortable with the current car lots they are having or having mental block (hidden agenda)

8. Face reality, no way we can satisfy all residents, MC will listen with empathy, weight the pros and cons and decision make will be base on the majority of the residents that is unit owners not tenant.

9. So called pollution if we have additional car lots, let’s face reality, “life and death are opposite side of the coin, if u accept 1, we have to accept the others, “meaning if we are willing to stay in an apartment, we need to have mindset of give n take, the 6 blocks does not belongs to u. It belong to all unit owners., if don’t want pollution, sell and and stay on top of the hill. Remember u owned 1% only, balance 99% of the units belongs to others.


10. We need this additional fund ( about RM 5k monthly) to sustain maint. Fee
and for future upgrading such as water tank and to paint the 6 blocks. MC
will also review cover park issue next year but owner have to bear the cost.

PDPI MC Desperados

To: All PDPI Residents & Unit Owners,

These bunch of MC members are getting desperate. Two days ago they instigated the gangster L KY that some residents are opposed to their plans for renovation and upgrading the garden area. This idiot LKY then threatened and assaulted two residents who later made police reports.

You can see the extend this desperado MC is prepared to go to implement their projects before they are kicked out at the next AGM.

They are now planning to speed up the implementation of 3 projects before the next AGM.

The projects are:
i). Car Park Flood prevention project behind Blocks K & L.
ii). Drainage system around PDPI and
iii). Garden upgrading project with addition swing and a concrete white Horse and a white Elephant for children of MC to play. ( this has been put on temporary hold after residents protest).

They do not have a quorum to approve these projects, so they use the following tactics:

i) After an MC meeting has ended and some members have left, they continue the meeting and approve the project by consensus ( all agreed? unanimous ? only haven knows) .
ii) or they have special meetings where selected MC members who support the projects are invited , other members are not informed. They are listed as absent.

Since this MC was elected, their record has been very poor/bad such as:
i). Car wash and Garbage area poorly implemented at a cost of RM14,000.00 ++
ii). Block Q ground floor water tank leakage repaired at a cost of RM17,000.00.++ Job completed in 2 days.
iii). Garden upgrading project. Architect paid RM950.00 to draw up the plans. (now project put on hold).
iv). Tenders given out to selected contractors only, so prices are inflated. You don’t have to know rocket science to find out.
v) Use gangster tactics to get approval of the projects and prevent residents from protesting.
vi). No transparency and accountability in their dealings, even MC members not aware.

Conclusion:
i) Residents judge for yourself, do we want to allow this to continue?
ii) Protest strongly and tell MC members you know, not to approve any more projects until the next AGM.
iii) Demand to know who are the MC members who voted to approve each project. No such thing as “approved by consensus” which means unanimous or no opposition.
iv) Don’t forget “Residents are the BOSS” MC is the servant of the residents. They must follow Residents orders otherwise they can quit.

Future PDPI MC

To: All Residents

Residents should get together to device a System or Rules to control and prevent abuses by future MCs. This System or Rules must be passed at the next AGM.
We need to control their powers so that they carry out the wishes of the residents because the residents are their Boss and the other way round.

Suggestions are:

1. RB can hold petty cash of up to RM500.00 only.

2. Any expenditure above RM500.00 but less than RM5,000.00 must call for tenders. MC can select and award the tender.

3. Any expenditure between RM5,000.00 and RM10,000.00 must be approved by this joint committee consisting of MC (5 members) and RA ( 5 members) and chaired by RB. After approval they will interview and award the tender.

4. Any expenditure above RM10,000.00 must be approved by an EGM. After approval, tenders are called and the tender awarded by the joint committee.

5. All tenders must be opened at a joint meeting of RB (chairman), MC (5 reps) and RA (reps). Selection and interview of tenders must also be done by this joint meeting.

6. In any emergency situation, where a job need to be done urgently, this joint committee of RB (chairman), MC (5 raps) and RA (5 raps) must meet, approve and make a decision.

The above will prevent some of the abuses by future MCs. I hope you all think about it and add any more rules necessary.

How to remove the MC

We can remove them by petitioning for an EGM with a resolution for a "VOTE OF NO CONFIDENCE".

According to the Strata Title Act 1985, SECOND SCHEDULE, PROVISIONS FOR MANAGEMENT CORPORATION, Clause 9 states as follows:

9. Extraordinary general meetings.
(1) A general meeting other than the annual general meeting shall be known as the extraordinary general meeting.

(2) The council -
(a) shall convene an extraordinary general meeting upon a requisition in writing made by the proprietors who are together entitled to at least one-quarter of the aggregate share units;


(b) shall convene an extraordinary general meeting upon receiving a direction in writing from the Director for the transaction of such business as the Director may direct; and

(c) may convene an extraordinary general meeting on such other occasion as it thinks fit.

(3) Where the Direction is satisfied that the council has not been properly constituted, he may authorise in writing any proprietor to convene an extraordinary general meeting for such purposes as may be approved by the Director.

Therefore, we need a quarter outof 528 units, ie. at least 162 signatures from registered strata title owners, not residents.

A lot of us are reluctant to sign for it because of Kam-chen. They will say "not nice lah, I know so and so's wife/husband lah", this is the main reasons these MC members ada-muka. They walk around the garden acting like they are the master of this place and they are the one that call the shot. They are insensitive towards the hostile stare of the community.

Actually, their term will expired sometimes January 2009, by right they should be preparing for thecoming AGM. Sources said that they still want to stick around until March 2009. Time is running out for them and they desperately push for anumbers of projects.

So did you get the picture. Anyone care to initiate an EGM for a vote of no confidence. I'll definately give you my hands and legs.

So we assumed the notice boards have been stolen.
A police report has made on their disappearance.

These notice boards belong to the residents, paid for by the residents.

Going to the dogs

Here's an article from a reader,Iwould like to share with every one.

Dear Sir,

I appreciate your concern about PDPI going to the dogs as the accumulated fund of > 600K is obviously the eye opener. Few if at all realize that our apartments are now > 10 years old. For some, even our wiring should be renewed not to mention the paint work of the ironmongery surrounding the 6 blocks of apartments. In the past, the original people who worked so hard to brilliantly combat the developer should be reinstated as MC committee members.

Slow they may be in getting things done, but there was lots of homework done to encompass safety, cost and practicality issues. Even then there were times when these people were targeted for abuse and false reports of corruption. The present MC has no consideration as to the hard work done previously and only support their own hidden agendas namely to suck the funds dry. After this, what next?

It is sad that there are so many gullible persons voting for unproven characters into the MC, break the chain of events and create havoc among the residents by spreading rumours when their main function is to maintain the buildings as best can be done. The previous batch of people involved never received a cent in terms of allowance or salaries too but the main purpose and agenda were well defined and executed to ensure most people are satisfied. This can be seen by the better maintenance collection over the times when the developer was holding the reins.

It’s time the community open their eyes and ears as to ensure the next MC members elected are responsible people not “internal home grown terrorists”.

提升/维修花园的招标

我相信在2008年12月6日下午你们会注意到布告栏上有个招标的广告吧.这是有关提升/维修的工程.

这招标是以”提升/维修”为前提.仔细的阅读布告上的所谓”简单图形以及规格”你会发觉所影响的面积有49尺x50尺,也就是说大概有2,500平方尺.范围将会把一半的脚底按摩园一直延展至鱼塘处.整片的地面将会铺上地砖.把花园草场的排水功能减少了后,还不知将来对环境的影响如何.还有毕竟要征用公共的地方,管理层委员竟然在没有征求大家的回授,竟然召开投标.在EGM是,管理层委员曾经许下诺言说不会把花园工程分解成较小的工程来进行.

这布告日期是2008年12月5日,然而截止日期是12月11日.扣除了周末以及公共假期,所剩时间只有3天.为什么这么急促呢?根据惯例,招标限期至少14天.3天!莫非已经早有安排吧

目前最重要的是排水/沟渠的问题.这厢没有解决,那厢又打起花园的主意.我所到之处,所谈起的只是那句”大概有人口渴了吧!不然一直死命的要推行工程”.然后大家心照不宣的一笑.

Tender to upgrade/repair the existing garden??

Some of you might have noticed that on Saturday (6/12/2008) afternoon, there was a notice calling for tender to upgrade/repair the existing garden.

The tender was called under the title of "UPGRADE/REPAIR". Look at the 'BRIEF DRAWING AND SPECIFICATION", the area involved was about 49ft x 50ft, that will give you a total area of approx. 2,500sq. ft. It stretches from the reflexology path right to the fish pond. It also shows that the whole area will be tiled up. What will be the environmental impact by covering up the surface drain-off of our garden. With such a vast area of common property involved, the MC members DONOT even bother to get the feedback from the residents/owners. Who do they think they are? During the EGM, the MC members had given their promise not to cut up project into smaller parcels.

The notice was dated 5th December 2008 and the closing date is set at 11th December. With the stretch of week-end and public holidays, potential contractors are left with only 3 (THREE) days to prepare this tender. Why such a haste? Normal practiceis to have at least 14 days to prepare and access the site. 3 days! Probably PRE-ARRANGEMENT has already being connected!

The atmost important flooding and drainage problem has not been settled, they are trying to attack the garden pulak! Everyone I met up has only one thing to say " People are probably thirsty therefore they are desperate to create more and more projects"

Yesterday morning some brave ladies confronted some of the MC members. Goh senior said he had corrected the date to 15th December. Goh Junior gave some brief explanation. But those ladies present insisted that the flood and drainage jobs should be placed at the top priority. Any other projects should be put on hold. Then the topic shifted to how to counter the flood problem. Look like the flood problem has been given the importance. You can never be sure, just keep on the look out for any funny tricks.


At the beginning, Goh senior was reminded about the promise of not to cut-up the garden into smaller parcel. The answer given was "It is about car-park issue", so this time their used the title "TO UP-GRADE/REPAIR THE GARDEN". Can some one report to the Commissioner of Buildings (COB) about this misleading tactics.

This coming morning 15th Dec. 2008 MC/RB will be having a meeting, @ 8.30pm. The tender was supposed to be discussed then. Here I would like to call upon unit owners who wish to attend the meeting to write in to the RB for permission to attend.

Thank goodness, the MC members had put this project on-hold.

At the present moment, flood and cracked drain problem will be the top on list.
The on-slaughter of the garden is temporary halt. Well until when? Keep our fingers cross.

各位居民协会会员,

关系居民协会(RA)贪污和侮辱性布告的控诉

请参考槟榔屿社团注册登记局(ROS)之来函,ref no: PPP/PPG 115/97 (30)。以下是最新的资讯。

9月2日,本人被召唤至ROS的办公室。理由是ROS接到很多投诉关于居民协会(RA)的贪污事件以及PDPI的布告栏上的一些侮辱性的布告。当天的晤谈还包括检查RA的记录和财政上的情形。

显然地,在居民之间有少数的失败者不顾一切向ROS 投诉,其目的就是要关闭我们居民协会。

关于投诉事项所作出的澄清如下:

1. 我告诉登记官那些投诉是毫无根据的因为RA纯粹是一个“快乐俱乐部”,通常我们会举办一些社交性的活动以联系感情。RA一向来都根据条律的规定,RA的财政报告经过审核后,都呈上到ROS。 RA根本没有插手于PDPI日常管理和财务方面的事项。还有RA也没有权力提呈计划或者作出契约(投票)上的任何决定。这些责任全属于管理层(MC)的范围,尤其现今管理层的财库中已经累积了大概有RM600,000多。不过,投诉者如发现任何贪污的迹象,本人现今很慎重的奉告他,赶紧向警察局报案。这些事项根本不属于ROS管辖的范围。

2. 关于布告栏的事件(MC所提呈的4项工程),本人已经在7月12日的布告上清清楚楚的交待过。居民有很多不满意MC的一面之辞,姑把他们本身的感想表达出来,为了避免居民随地的黏贴,如电梯门上、玻璃镜上,RA决定让他们把布告黏贴在RA的布告栏上。本人相信任何一个有公德心的居民都会赞同本人的看法。这有助于环境的清洁以及比较民主吧。RA事先已经申明,布告上所言纯粹属于笔者的观点并不代表RA的立场。在此本人再次奉告投诉者,如觉得布告有任何侮辱的话,赶紧向警察局报案。此事不属于ROS管辖的范围。

3. 大家都有一个共识;RA是开放给全体PDPI的居民。会员必须是马来西亚公民并且是要满18岁以上。然而,MC是一个属于拥有合法分层地契业主的组织。两者根本就是两种不同样的性质组织。

RA非常感激ROS官员的忠告关于如何能够有条有理的执行本身的职务。RA也衷心感谢官员能够理解RA的奋斗,因为RA就是靠一班关心PDPI的居民,自发自愿,任劳任怨的默默耕耘。

最后,RA向这班不甘心的失败者传达一个讯息:你们没法让RA关门大吉

Dear RA Members,

Re: ADUAN-ADUAN “MAKAN RASUAH & OFFENDING NOTICES” ON RA
I refer to Jabatan Pendaftaran Pertubuhuhan Pulau Pinang (ROS) letter ref no: PPP/PPG 115/97 (30) which is attached herewith for your reference. The below report is an update.

On the 2nd Sept, I was summoned to the ROS office with regard to a request for “PEMERIKSAAN”. (the secretary and treasurer couldn’t make it on that day ) I was shocked when was told that the purpose of the visit was to interview the Chairman with regards to “banyak aduan-aduan telah diterima oleh ROS bahawa RA makan rasuah dan notis notis “offending” dipamerkan di papan kenyataan PDPI. The interview also looked into the record and financial status of the RA.

Apparently we have loser/losers among the residents who resorted to make these aduan-aduan to the ROS with the aim of closing down (tutup kedai) the RA!

These aduan-adaun were clarified and concluded with the officer as follow:

1. I told the officer these accusations are baseless as the RA is just a “HAPPY CLUB” organising social activities for the residents to get along well and living in harmony. As required by law, the RA account is in order and has been audited and submitted to the ROS. The RA does not involve itself in managing and overlook all expenses with regard to the daily and monthly running of this property. The RA is not involved in creating projects and awarding of contracts. That responsibility lies with the MC that manages the fund Rm600,000.00+. However, if there is any basis for makan rasuah, the complainant should lodge a police report as the ROS has no jurisdiction on this matter.

2. The issue of posting notices (on the 4 projects proposed by the MC) on the RA’s notice board was very much clarified via our posted letter dated 12th July 2008. The RA was merely helping the residents in putting up their notices in the RA’s notice board instead of gluing them on the lift wall and glass panel. The RA is helping to keep the place clean. I believe most civil minded residents did observe such instruction. The view expressed was solely of the resident NOT the RA. Again if the complainant felt the notice is offensive, he should lodge a police report as the ROS has no jurisdiction on this matter.

3. We also agreed that the RA is opened to ALL RESIDENTS that reside at Pangsapuri Desa Permai Indah. Membership is only for Malaysian above 18. The MC is a body for registered owner with Strata Title. These are 2 different entity.

The RA would like to thank the ROS’s officer for his advice on running a proper association based on our stipulated rules and regulation. The RA would also like to thank the officer for his understanding on our struggle in running the RA, which is operated voluntary by concerned residents.

The RA’s message to loser/losers making these aduan-aduan (for reason best known to you), YOU HAVE FAILED TO CLOSE DOWN THE RA!
